⚠️ Why Excision in Progress Can Be Risky (and How to Verify It)

⚠️ Why Excision in Progress Can Be Risky (and How to Verify It)

Many lands in Lagos are advertised as “Excision in Progress” but what does this really mean, and why should you be careful as an investor?

---

🔎 What Does Excision in Progress Mean?

When land is under *government acquisition*, the indigenous family or community can apply for Excision, asking the government to release a portion of that land back to them.

Excision in Progress simply means the request has been submitted but is not yet approved or documented in the official Gazette.

Until the excision is granted, the land technically still belongs to the government.

---

⚠️ Why It’s Risky

1. Uncertainty of Approval

The government may reject the application, meaning the land remains permanently acquired.

2. No Legal Ownership Yet

You cannot process C of O or Governor’s Consent on land under Excision in Progress.

3. High Risk of Demolition

If you build on such land before approval, the government has the right to demolish or reclaim it.

4. Fraudulent Sales

Some communities or land speculators sell such land knowing investors may never get valid ownership.

---

✅ **How to Verify Excision in Progress

1. Check with the Lagos State Ministry of Lands

Visit the Alausa Land Registry to confirm the application status.

2. Engage a Licensed Surveyor*

They can run the coordinates of the land through the official survey database to know its status.

3. Request the Application File Number*

If the family or seller claims Excision in Progress, ask for proof of submission (file number at the Lands Bureau).

4. Consult a Property Lawyer*

A lawyer can help you confirm if the land is safe and advise whether to proceed or avoid it.

---

📌 **Investor Tip

👉 If you must buy land under *Excision in Progress*, make sure it’s from a *trusted estate developer* with verifiable records and proper documentation of the application.

👉 The safest path is to *invest in lands with already approved titles* (C of O, Gazette, Governor’s Consent).
